March 23, 2011	Filing 108 OPINION AND ORDER AFFIRMING AGENCY ACTION. The Court finds that the Park Service complied with NEPA when eliminating a natural wolf population as a reasonable alternative from the EIS and that the alternative that incorporates the culling of elk by public volunteers does not contravene either the Organic Act or the RMNP Act. The Park Service's decision to use authorized agents to cull elk in RMNP was not arbitrary, capricious, or otherwise contrary to law. The 36 Park Service's decision is AFFIRMED. The Clerk of the Court shall enter judgment in favor of the Defendant and close this case, by Judge Marcia S. Krieger on 03/23/2011. (wjc, )

Filing 108 OPINION AND ORDER AFFIRMING AGENCY ACTION. The Court finds that the Park Service complied with NEPA when eliminating a natural wolf population as a reasonable alternative from the EIS and that the alternative that incorporates the culling of elk by public volunteers does not contravene either the Organic Act or the RMNP Act.
