TRANSFER ORDER: The Eastern District of New York is not the proper venue for this action. Jurisdiction over the petition properly lies in the district of confinement, Rumsfeld v. Padilla, 542 U.S. 426, 443 (2004), and Petitioner is detained at ADMAX in Florence, Colorado. Accordingly, the Court directs the Clerk of Court to transfer this action to the District of Colorado. The Court offers no opinion on the merits of this action and declines to decide Petitioner's #2 pending IFP application, which is reserved for the transferee court. The Court waives the provision of Local Rule 83.1, which requires a seven-day stay. No summons shall issue from this Court. The Clerk of Court is directed to close this case.
