ORDER DISMISSING CASE. Plaintiff Jabari Johnson is in the custody of the Colorado Department of Corrections and currently is incarcerated in the Colorado State Penitentiary at Caon City, Colorado. Plaintiff initiated this case on April 2, 2020. This Court has imposed filing restrictions against Plaintiff based on his abusive litigation in this Court. The Court finds that this action is subject to dismissal for failure to comply with the filing restrictions set forth in Case No. 19-cv-03730-LTB, because this lawsuit is found to be interposed for the purpose to harass or cause unnecessary delay. The Court also will impose a $400 money sanction against Plaintiff for failing to comply with the warning in Case No. 20-cv-00095-LTB. That the Clerk of the Court is directed to terminate this case and close the action because Plaintiff has failed to comply with the sanction order entered in Johnson v. Hawkins, et al., No. 19-cv-03730-LTB, ECF No. 10 (D. Colo. Mar. 4, 2020),and the warning in Johnson v. Weber, et al., No. 20-cv-00095-LTB, ECF No. 9 at 9 (D.Colo. Mar. 5, 2020). That pursuant to 28 U.S.C. ' 1915(a)(3) any appeal from this Order is not taken in good faith, and, therefore, in forma pauperis status is denied for the purpose of appeal. That pursuant to 28 U.S.C. 1915(f)(2)(A) Plaintiff shall pay to the Clerk of the Court a monetary sanction of $400 to cover the cost and expenses of this action. That the Clerk of the Court is directed to provide a copy of this Order to the [email protected]. That all pending motions are denied as moot. by Judge Lewis T. Babcock on 4/8/2020.
