ORDER re: #5 NOTICE OF PLAINTIFFS VOLUNTARY DISMISSAL UNDERF.R.C.P. 41(a)(1)(A)(i). Plaintiff filed his notice pursuant to Rule 41(a)(1)(A)(i) for the Federal Rules of Civil Procedure. This Rule allows a plaintiff to dismiss an action, without Court order, if certain requirements have been met. See Fed. R. Civ. P. 41(a)(1)(A)(i). Defendants have not answered or otherwise entered their appearance in this matter. Accordingly, the Rule 41 requirements have been met. Therefore, this matter was dismissed, without Court order, at the time of filing. Accordingly, IT IS ORDERED that the Clerk of Court shall TERMINATE this matter. SO ORDERED by Magistrate Judge S.
