February 14, 2024 Filing 23 MINUTE ORDER: Before the Court is ECF #22 "Defendant DoorDash, Inc.'s Notice of Non-Opposition to Plaintiff's Motion to Dismiss for Lack of Subject Matter Jurisdiction or, Alternatively, Motion to Compel Arbitration." Defendant states it does not oppose Plaintiff's "request 'the court [] dismiss this matter with prejudice for lack of subject matter jurisdiction... '" ECF 22 at 1. It is evident, however, from the substance of the underlying motion (ECF #19 ) that the relief sought by Plaintiff--who is proceeding in this matter pro se--is that this Court compel arbitration of the underlying dispute. Defendant entirely fails to address Plaintiff's request that the Court "compel Defendant to proceed with binding arbitration according to [t]he terms of the Doordash inc [sic] Mutual Arbitration Provision." ECF 19 at 2. Accordingly, it is ORDERED that on or before February 20, 2024, Defendant shall supplement its Notice to apprise the Court of its position as to Plaintiff's request the Court compel arbitration of this dispute. Accompanying its supplement, Defendant shall also provide a complete copy of the "Doordash inc [sic] Driver Non-Disclosure and Dispute Resolution Agreement." See ECF 14-11. January 18, 2024 Opinion or Order Filing 7 MINUTE ORDER: Defendant Door Dash, Inc., removed this case to federal court today pursuant to 28 U.S.C. 1332(a). See [Doc. #1 ]. Under Rule 7.1(a)(2) of the Federal Rules of Civil Procedure, "[i]n an action in which jurisdiction is based on diversity under 28 U.S.C. 1332(a), a party... must, unless the court orders otherwise, file a disclosure statement" that "name[s] - and identif[ies] the citizenship of - every individual or entity whose citizenship is attributed to that party or intervenor." Fed. R. Civ. P. 7.1(a)(2). The Court notes that, for purposes of diversity jurisdiction, "[a]n individual's residence is not equivalent to his domicile and it is domicile that is relevant for determining citizenship." Siloam Springs Hotel, L.L.C. v. Century Sur. Co., 781 F.3d 1233, 1238 (10th Cir. 2015); see also Middleton v. Stephenson, 749 F.3d 1197, 1200 (10th Cir. 2014) ("[A] person acquires domicile in a state when the person resides there and intends to remain there indefinitely."). Although Defendant has filed a #2 Corporate Disclosure Statement, it does not comply with the requirements of Rule 7.1(a)(2) because it does not disclose Defendant's state of citizenship. Accordingly, it is ORDERED that, on or before January 26, 2024, Defendant SHALL FILE a Rule 7.1(a)(2) disclosure statement identifying its state of citizenship. Additionally, Plaintiff Milan Nikolic, who has not yet entered an appearance in this case, SHALL FILE the requisite Rule 7.1(a)(2) disclosure statement "with [his] first appearance, pleading, petition, motion, response, or other request addressed to the court."
