Filing 60 ORDER. The case is DISMISSED as to defendant Deputy Warden Iweka pursuant to Rule 25(a). The Motion for Summary Judgment 47 is granted as to all defendants with respect to the second incident on August 10, 2014. The motion for summary judgme nt is otherwise DENIED. The case proceeds on the Eighth Amendment excessive force and failure to intervene claims as well as the state law claims of assault and battery against defendants Counselor Supervisor Peterson, Captain James Watson, Lieutenants Kenny and Santopietro, and Correctional Officers Griffin, Smith, Rowold, R.
