Filing 31 ORDER AMENDING INITIAL REVIEW ORDER(see attached). Pursuant to Plaintiff's resentencing, and the 26 28 Responses of the Parties as to the legal effect of that intervening event, the Court hereby AMENDS the 12 Initial Review Orde r ("IRO") to omit Plaintiff's Fourteenth Amendment due process claim as to the continued application of the out-of-cell restraint policy on his person, and his Fourteenth Amendment equal protection claim as to the imposition of that policy on the class of death row prisoners who have yet to be resentenced. Filing 12 INITIAL REVIEW ORDER and SCHEDULING ORDER (see attached), dismissing the 1 Complaint in part, pursuant to 28 U.S.C. § 1915A. The clerk shall verify the current work addresses of all named Defendants and mail a waiver of service of proce ss request packet to each defendant on or before Tuesday, March 6, 2018. Defendants shall respond to the cognizable claims in Plaintiff's Complaint, as recited in this Order, within sixty (60) days of the date the waiver form is se nt.
