ORDER. Plaintiff Gerald J. Silva, currently incarcerated at the Federal Correctional Institution in Danbury, Connecticut, has filed a complaint along with a $350.00 filing fee. The filing fee to commence a civil rights action is $400.00. Title 28, section 1914(a), of the United States Code sets the filing fee to commence a civil action at $350.00. However, subsection (b) directs the clerk also to collect such additional fees as prescribed by the Judicial Conference of the United States. Section 14 of the Judicial Conference Schedule of Fees sets a $50.00 administrative fee for filing a civil suit. This administrative fee applies to all litigants who have not been granted in forma pauperis status.As the plaintiff has not been granted in forma pauperis status, he must pay the $400.00 fee. The plaintiff is directed to tender the additional $50.00 fee within twenty days from the date of this order. Failure to tender the fee may result in the dismissal of this action.
