Filing 12 ORDER. On July 1, 2019, the undersigned scheduled an in-person status conference in this matter to address the self-represented plaintiff's #1 Complaint and #2 Motion for Leave to Proceed in forma pauperis. See Docs. #7, #8 ; see also Doc. #9 (Amended Notice of E-Filed Calendar). The Court scheduled the in-person conference in an effort to better understand the allegations of the Complaint, and to discuss pleading and filing requirements in federal court. The Court held the in-person status conference on August 2, 2019, as scheduled. See Doc. #10 . Although the Court waited over 30 minutes for plaintiff to arrive, he failed to appear at the duly noticed conference. See id. Later on August 2, 2019, plaintiff filed with the New Haven Clerk's Office over 50 pages of documents, presumably in response to his missed appearance. See Doc. #11 . One of those documents indicates that plaintiff may currently be homeless, and thus faces a hardship appearing in New Haven.Accordingly, at this time, the Court will permit plaintiff to choose whether or not to proceed with a rescheduled in-person conference in this matter. If plaintiff wishes to appear for an in-person conference to further discuss the Complaint's allegations, then on or before August 26, 2019, plaintiff shall file a Notice on the docket stating that he would like to reschedule the August 2, 2019, status conference. If, however, plaintiff does not wish to proceed with an in-person conference, then the Court will review plaintiff's #1 Complaint and #2 Motion for Leave to Proceed in forma pauperis on the papers. If plaintiff fails to file a Notice by August 26, 2019, the Court will presume that plaintiff has elected not to proceed with an in-person conference in this matter.Although at this time the Court will allow plaintiff to choose whether or not to proceed with an in-person conference, he may be required to appear in person for future Court proceedings. It is so ordered. Signed by Judge Sarah A. L. Merriam on 8/5/19. (Dowie, C) |
