Filing 13 ORDER denying #11 Motion for Hearing. This case is closed and, therefore, there is no need for a hearing. Accordingly, plaintiff's request to conduct a hearing is denied. It is so ordered. Signed by Judge Sarah A. L. Merriam on 1/9/2020. (Scholfield, D.) |
Filing 12 ORDER REFERRING CASE to Magistrate Judge Sarah A. L. Merriam for Ruling on motion including #11 MOTION for Hearing Signed by Judge Kari A. Dooley on 1/08/2020.Motion referred to Sarah A. L. Merriam(Gould, K.) |
Filing 11 MOTION for Hearing by Steven Bryan. (Bozek, M.) |
Filing 10 ORDER adopting #8 Recommended Ruling. The Court has reviewed Magistrate Judge Merriam's Recommended Ruling concerning the #1 Complaint. The Recommended Ruling contains an accurate statement of the applicable law and a thoroughly reasoned analysis and application of that law to the circumstances presented here. The Recommended Ruling therefore is Accepted, Adopted and So Ordered. Neither an objection nor an Amended Complaint was filed by December 23, 2019 as required. Accordingly, the matter is dismissed and the Clerk of the Court is directed to close this file. Signed by Judge Kari A. Dooley on 1/02/2020. (Gould, K.) |
Filing 9 NOTICE. Paper copies of the Order docketed at Doc. #7 and the Recommended Ruling docketed at Doc. #8 were mailed to plaintiff on November 26, 2019, but were returned to the Court by the U.S. Postal Service on December 2, 2019. The Court mailed these documents to plaintiff again on December 2, 2019. Because the delivery of these documents to plaintiff has been delayed, the Court will extend the deadline for plaintiff to respond to the Recommended Ruling. If plaintiff disagrees with the recommendations in the Recommended Ruling (Doc. #8 ), he may file an objection on or before December 23, 2019. Failure to file an objection by this deadline will preclude appellate review. In the alternative, if plaintiff wishes to accept the Recommended Ruling and pursue his claim(s), he must file an amended complaint on or before December 23, 2019. It is so ordered. Signed by Judge Sarah A. L. Merriam on 12/2/2019. (Spangenburg, S.) |
Filing 8 RECOMMENDED RULING. For the reasons set forth in the attached Recommended Ruling, the Court recommends that the #1 Complaint be DISMISSED, without prejudice to re-filing. If plaintiff disagrees with the recommendations in this Ruling, he must file an objection on or before December 16, 2019. Failure to file an objection by this deadline will preclude appellate review. In the alternative, if plaintiff wishes to accept the Recommended Ruling and pursue his claim(s), he must file an amended complaint on or before December 16, 2019. Signed by Judge Sarah A. L. Merriam on 11/25/2019. (Katz, S.) |
Filing 7 ORDER granting #2 Motion for Leave to Proceed in forma pauperis. Plaintiff has filed a motion seeking to proceed without payment of fees and costs, which motion includes a sworn statement as to plaintiff's current financial circumstances. See Doc. #2 . Plaintiff asserts that he is unable to afford to pay fees and costs, as he is unemployed, homeless and has no income or assets. See id. at 2-5. At this stage, such allegations are sufficient to establish that plaintiff is unable to pay the ordinary filing fees required by the Court. See 28 U.S.C. 1915(a)(1). Accordingly, plaintiff's #2 Motion for Leave to Proceed in forma pauperis is GRANTED. Nevertheless, the Court notes that although plaintiff has filed numerous other lawsuits in this District, he has failed to list each of those lawsuits in the space provided on the Motion for Leave to Proceed in forma pauperis. See Doc. #2 at 4. The Court reminds plaintiff that the financial affidavit attached to his motion is a sworn statement, and therefore must be completed in a truthful manner. It is so ordered. Signed by Judge Sarah A. L. Merriam on 11/25/2019. (Katz, S.) |
Filing 6 ORDER REFERRING CASE to Magistrate Judge Sarah A. L. Merriam for Ruling on #2 MOTION for Leave to Proceed in forma pauperis and review of the complaint pursuant to 28 U.S.C. 1915. Signed by Judge Kari A. Dooley on 11/20/2019.Motion referred to Sarah A. L. Merriam(Gould, K.) |
