For the reasons set forth in the attached opinion, plaintiffs' motion for a preliminary injunction is GRANTED as follows:(1) The Governor of Connecticut shall modify Executive Order No. 7E so that as of June 15, 2020, the fingerprint collection requirements imposed by law under Conn. Gen. Stat. 29-17c(a) are no longer suspended for applicants who seek fingerprints for purposes of a permit or certificate to acquire, carry, or possess firearms that are subject to protection under the Second Amendment; and,(2) The Commissioner of the Department of Emergency Services and Public Protection shall not later than June 15, 2020, resume fingerprint collection activities at DESPP locations as required under Conn. May 14, 2020 Opinion or Order Filing 23 ORDER RE HEARING ON MOTION FOR TEMPORARY RESTRAINING ORDER AND PRELIMINARY INJUNCTION. The Court will conduct a video hearing on plaintiffs' motion for a preliminary injunction (Doc. #14 ) at 10:00am on June 1, 2020. The Court in due course will post video and audio access information for access by counsel, the parties, and the public on the docket. At this hearing the parties should be prepared to present fact evidence and oral argument on questions of law. As discussed with counsel during today's telephone status conference, the conduct of an evidentiary hearing by video poses significant logistical challenges. Accordingly, counsel are ORDERED to meet and confer no later than May 27, 2020, with a view toward narrowing as much as possible any factual or evidentiary disputes and streamlining the presentation of any evidence at the hearing. Counsel shall file on the docket by 12:00pm on May 29, 2020, a joint pre-hearing memorandum that (1) recites all agreed-upon facts, (2) attaches any documents or other exhibits that have not been otherwise filed on the record in this case and that any party intends to rely on during the course of the hearing, (3) lists the name of each witness that any party intends to call during the course of the hearing and that summarizes the substance of the witness's anticipated testimony. May 11, 2020 Opinion or Order Filing 11 ORDER RE MOTION FOR TEMPORARY RESTRAINING ORDER AND PRELIMINARY INJUNCTION. Plaintiffs have filed an emergency motion for temporary restraining order and preliminary injunction (Doc. #3 ). Rule 65 of the Federal Rules of Civil Procedure allows a court to enter a temporary restraining order without written or oral notice to the adverse party only if "(A) specific facts in an affidavit or a verified complaint clearly show that immediate and irreparable injury, loss, or damage will result to the movant before the adverse party can be heard in opposition; and (B) the movant's attorney certifies in writing any efforts made to give notice and the reasons why it should not be required." Fed. R. Civ. P. 65(b)(1). Because plaintiff's papers lack the required certification of movant's attorney, the Court does not understand plaintiffs to be seeking entry of any order of relief until such time as the defendants have had adequate time to file a response. In light of the constitutional question presented, the Court will require the filing of an expedited response by defendants on or before May 18, 2020, and for plaintiffs to file any reply to defendants' response by May 21, 2020, with a hearing to be scheduled on a date soon afterwards. The parties' filings shall indicate whether they have any disagreements as to the facts that are material to the legal issues presented. To ensure that each one of the defendants has appropriate notice, plaintiffs shall file a status report by May 12, 2020, detailing what steps that plaintiffs have taken to serve process and notice on each of the defendants. Plaintiffs shall also file by May 12, 2020 a proposed order specifying the terms of relief they preliminary seek pursuant to Fed. R. Civ. P. 65(d)(1)(B) and (C). It is so ordered.
