Reset Deadline: Dismissal due by 6/15/2021 (Barry, Donna) |
Filing 7 ORDER. On March 17, I denied without prejudice Carolina's motion to proceed in forma pauperis because his motion did not "contain enough information to allow me to conclude that he cannot pay the standard $402 civil case filing fee." Order, Doc. No. 6. I told Carolina that he "may be able to proceed in forma pauperis in this matter, but he must submit a motion with more detailed and accurate statements about both his income and expenditures." Id. To date, Carolina has not filed a renewed motion to proceed in forma pauperis. I remind Carolina that, to proceed with this case, he must either pay the civil filing fee or re-file his motion to proceed in forma pauperis. If he does not do so sometime before June 15, 2021 -- or provide a reason why he has not -- I will be likely to dismiss this case either for failure to prosecute and/or for a failure to effect service in a timely manner pursuant to Fed. R. Civ. P. 4(m).Signed by Judge Stefan R. Underhill on 04/21/2021. (Rosenberg, J.) |
Filing 6 ORDER denying without prejudice #2 Carolina's motion to proceed in forma pauperis. Carolina's motion does not contain enough information to allow me to conclude that he cannot pay the standard $402 civil case filing fee. For instance, according to Carolina's motion, he has both $0 in income and $0 in obligations. Although Carolina indicates that he is unemployed and receives government benefits, he does not explain what benefits and in what amounts. In addition, Carolina writes that he spends $0 per month on food, clothing, and other necessary expenditures. Carolina may be able to proceed in forma pauperis in this matter, but he must submit a motion with more detailed and accurate statements about both his income and expenditures. Signed by Judge Stefan R. Underhill on 03/19/2021. (Rosenberg, J.) |
