December 7, 2021 Opinion or Order Filing 7 ORDER denying #2 Motion for Leave to Proceed in forma pauperis. The plaintiff, Carvaughn Johnson, is incarcerated at MacDougall-Walker Correctional Institution. He sues seven employees of the State of Connecticut Department of Correction and seeks leave to proceed without paying the filing fee under 28 U.S.C. 1915. See ECF Nos. 1, 2. The Court considers whether information provided by the plaintiff demonstrates that the burden of paying the $402.00 filing fee would hamper his ability to obtain the necessities of life or force him to abandon a potentially meritorious claim. See Adkins v. E.I. Dupont de Nemours & Co., 335 U.S. 331, 339-40 (1948). The plaintiff acknowledges that he has received income in the amount of $49.50 a month for performing his job as a medical janitor during the twelve-month period preceding the filing of this action. See ECF No. 2 at 2. The ledger sheets submitted by the plaintiff in support of his application to proceed in forma pauperis reflect an inmate account balance of $423.51 as of November 10, 2021, and total deposits to the account of $398.20 in connection with the performance of the plaintiffs prison job, including bio-hazard pay, during the five-month period preceding the filing of this action. See ECF No. 3. The plaintiff is not responsible for room and board. See ECF No. 2 at 3. Although the plaintiff states that he sends $200.00 to $300.00 a month to his nephew as needed, his inmate account reflects only one lump sum withdrawal of $300.00 from his account in the last six months. See ECF No. 2 at 6; ECF No. 3 at 2. The Court cannot discern whether this withdrawal was sent to the plaintiffs nephew. The court concludes that the plaintiff has failed to demonstrate that he would have to forgo lifes necessities or abandon this action if he paid the $402.00 filing fee. Accordingly, the motion to proceed in forma pauperis, [ECF No. 2], is DENIED. All further proceedings in the matter shall be held in abeyance Until December 27, 2021 pending the plaintiffs delivery of the filing fee in the amount of $402.00 (cash, money order, or bank or cashiers check made payable to the Clerk, U.S. District Court) to the Clerks Office, 915 Lafayette Boulevard, Bridgeport, Connecticut, 06604. Failure to tender the filing fee by December 27, 2021 will result in the dismissal of this action. SO ORDERED. Signed by Judge Kari A. Dooley on 12/7/21. (Dooley, Kari)
