With respect to Plaintiff's request for appointment of counsel, as the court has previously stated, see ECF No. 86, is unclear from the present record whether Plaintiff's claims are of sufficient merit to warrant an appointment of counsel. This motion therefore must be denied, but Plaintiff may renew her request at a later time, once the merits of her claims are clearer.With respect to the motion for clarification, it appears to the court that Defendant H.N.S. Management Co., Inc. (doing business as CT Transit), actually is seeking a determination as to whether service of process on another defendant was effective. In the first instance, a motion for clarification is an improper vehicle for such a request, as the question is not one of understanding but of application. Moreover, though, H.N.S. Management Co., Inc., already has appeared and filed a response to the complaint in this action, so it is not clear what interest it could have in the service of another defendant. In the motion, Plaintiff asks the court (1) to explain discovery procedures, (2) to issue another summons for the defendants who have not yet been served, and (3) to appoint counsel. With respect to the first request, the court cannot advise Plaintiff in how to litigate her case, but the court will direct Plaintiff to (1) the Pro Se Guide which the Clerk of Court mailed to her home and which is available online at https://www.ctd.uscourts.gov/sites/default/files/forms/Guide-for-Self-Represented-Litigants-revised-3-7-2022.pdf, (2) the Local Rules of Civil Procedure for the District of Connecticut, and particularly Local Rule 26 (available online at https://www.ctd.uscourts.gov/sites/default/files/Revised-Local-Rules-11-22-2021_0.pdf), and (3) the Federal Rules of Civil Procedure, and particularly Rule 26 (available online at https://www.uscourts.gov/sites/default/files/federal_rules_of_civil_procedure_-_december_2020_0.pdf). The court will also specially note that, per Local Rule 5(f)(1) and Federal Rule 5(d)(1)(A), Plaintiff should not file any discovery with the court unless it is being used in a proceeding or the court orders otherwise. With respect to the second request, the court notes that Plaintiff filed her Third Amended Complaint on March 24, 2022, see ECF No. #30 , and therefore Plaintiff should have served all defendants by June 22, 2022, but apparently has not done so. However, taking into consideration Plaintiff's pro se status, the court finds that Plaintiff has shown good cause for the failure; specifically, Plaintiff states in her motion that she and her family have been ill and she has taken a demanding job as a truck driver. Therefore, in accordance with Federal Rule of Civil Procedure 4(m), the court will grant additional time to serve all remaining defendants. Plaintiff shall effect service on all remaining defendants on or before September 16, 2022. No further extensions of time will be granted with respect to service. The Clerk of Court is instructed, respectfully, to issue a summons with respect to all defendants except First Transit, Inc.; CT Transit; and H.N.S. Management Co., Inc.Finally, with respect to the third request, the Second Circuit has cautioned the district courts against the "routine appointment of counsel." Cooper v. A. Sargenti Co., 877 F.2d 170, 173-74 (2d Cir. 1989). Thus, in considering whether to appoint pro bono counsel for an indigent litigant, a district court must "first determine whether the indigent's position seems likely to be of substance." See Hodge v. Police Officers, 802 F.2d 58, 61 (2d Cir. 1986). If the claims are sufficiently meritorious, the court should then consider other factors bearing on the need for appointment of counsel, including the movant's ability to investigate the factual issues of the case, whether conflicting evidence implicating the need for cross-examination will be the major proof presented, the movant's apparent ability to present the case, and the complexity of the legal issues involved. See Hodge, 802 F.2d at 6162. The court notes that it is not clear whether Plaintiff is indigent, but even if she were, it is also unclear from the present record whether Plaintiff's claims are of sufficient merit to warrant an appointment of counsel. At this time, the court must deny the request for appointment of counsel, but Plaintiff is not precluded from filing another motion for appointment at a later time in this matter. Filing 27 ORDER. The court thanks Plaintiff for her submissions dated February 25, 2022, see ECF No. 20, and February 28, 2022, see ECF No. 21. Despite her efforts, however, her filings do not quite conform to the requirements of the Federal Rules of Civil Procedure. Rule 8 requires that a complaint provide a short and plain statement of the claims of each pleader and state the relief that each pleader seeks. Fed. R. Civ. P. 8(a). And Rule 10 requires that each fact alleged in a complaint be stated in a separate, numbered paragraph. Plaintiff's recent filings do not satisfy these requirements, and therefore, the court cannot accept them as her operative pleading. However, the court will grant Plaintiff another opportunity to file a third amended complaint that does satisfy the Rules. The court recommends, but does not require, that Plaintiff use the same form she used to file her original Complaint, see ECF No. #1 , and in any case the court instructs Plaintiff to make sure that her third amended complaint is laid out in short, numbered paragraphs and includes (1) all claims against the defendants, (2) all parties who are seeking damages from the defendants, and (3) the amount of damages sought. Plaintiff is also instructed to refrain from attaching any documents containing personal medical information as an exhibit to the third amended complaint. Plaintiff shall file her third amended complaint on or before March 25, 2022. Failure to comply with this order may result in this action being dismissed. It is so ordered. Signed by Judge Omar A. Plaintiff asserts that she would like to increase the amount of damages she is seeking to account for damages due to her children and spouse. Federal Rule of Civil Procedure 17(a)(1) permits a party to sue on behalf of individuals for whom they are a legal guardian, and so it seems likely that Plaintiff may sue on behalf of her minor children, but it is not clear that Plaintiff may sue on behalf of her spouse. Accordingly, the court grants Plaintiff's #18 motion, and instructs her to file her Third Amended Complaint on or before February 25, 2022. In the Third Amended Complaint, Plaintiff is instructed to list all parties on whose behalf she is seeking damages, and in what capacity. Plaintiff shall list by their own legal name any party who is seeking damages for whom Plaintiff is not (1) an executor; (2) an administrator; (3) a guardian; (4) a bailee; (5) a trustee of an express trust; (6) a party with whom or in whose name a contract has been made for another's benefit; or (6) a party authorized by statute. Finally, the court reminds Plaintiff that she is required to serve her complaint upon all defendants in this matter in accordance with Federal Rule of Civil Procedure 4 and the Notice to Counsel/Self-Represented Parties, see ECF No. 8.
