Set Deadlines as to #14 MOTION to Dismiss ; Responses due by 5/6/2022. (Velez, F.) |
Filing 20 ORDER denying ECF No. #18 Motion for Extension of Time. Defendants seek an extension of time in which to file a reply brief in support of their pending motion to dismiss, see ECF No. #14 , citing other professional obligations and three exhibits Plaintiff filed in support of her opposition to that motion to dismiss, see ECF Nos. #15 , #16 , #17 . Plaintiff does not consent to the extension of time, arguing that the habeas petition is now fully briefed and should be ruled on without any reply from Defendants. The court finds it in the interest of justice in this case to accept a reply brief from Defendants, but concludes that Defendants have not shown good cause for an extension to May 9. In the first instance, Defendants have mistaken the reply deadline. Defendants' argument is premised upon the incorrect assertion that the reply is due within 10 days of Plaintiff's response, but Local Rule of Civil Procedure 7(d) provides that a reply memorandum shall be filed within 14 days of a response. Furthermore, with respect to the exhibits Plaintiff filed, none of them appears to contain any information which is new to the Defendants, and in fact two of the exhibits are documents which apparently originated from Defendants, themselves. Accordingly, the court denies the motion for an extension of time. Defendants shall file any reply memorandum on or before May 6, 2022. It is so ordered. Signed by Judge Omar A. Williams on 4/26/22.
