Filing 8 ORDER taking under advisement #2 plaintiff's Motion for Leave to Proceed In Forma Pauperis. Plaintiff has filed a motion to proceed in forma pauperis. Because plaintiff resides at "Sierra," it is not clear to the Court whether he is in fact a sentenced inmate of the Department of Correction serving a sentence (either for the substantive offense or for a violation of special parole), or whether he is residing at Sierra voluntarily, or as a condition of special parole or probation. If plaintiff is a "prisoner" and has an Inmate Trust Account, he must file an Inmate Trust Account statement for the six months preceding the date of the Complaint, that is, from December 24, 2021, through June 24, 2022. If plaintiff is not a "prisoner" and has no Prisoner Trust Account, he must file a Notice to that effect, and explain to the Court the source of any income he has and how the cost of his housing is paid. Plaintiff shall file either a copy of the Inmate Trust Account as directed, or a Notice explaining why he does not have such an account, on or before July 22, 2022. Failure to comply with this Order may result in denial of the motion to proceed in forma pauperis. It is so ordered. Signed by Judge Sarah A. L. Merriam on 6/30/2022. (Teague, J.) |
Filing 7 ORDER. Plaintiff has filed a Complaint, which he filed by appearing in person at the Clerk's Office of the New Haven Courthouse. See Doc. #1 . The Complaint is dated January 17, 2020, see id. at 18, but was filed on June 24, 2022. The Clerk's Office properly listed plaintiff's address in the docket as the address on the Complaint, at Corrigan Correctional Center. However, plaintiff's motion to proceed in forma pauperis, filed at the same time and dated June 24, 2022, reflects that his current mailing address is: 48 Howe Street, 4th Floor, New Haven, CT, 06511. See Doc. #2 at 2. This is consistent with the Department of Corrections website, which indicates that plaintiff resides at "Sierra," a facility located at that address. Accordingly, the Clerk is hereby ORDERED to update plaintiff's address to 48 Howe Street, 4th Floor, New Haven, CT, 06511, phone number 203-809-8328. Plaintiff is advised that he must file a Notice of Change of Address with the Court promptly if his address changes at any time. Failure to do so may result in dismissal of this matter. It is so ordered. Signed by Judge Sarah A. L. Merriam on 6/30/2022. (Teague, J.) |
Filing 6 ORDER. All counsel and self-represented parties are advised that any requests for relief, including the rescheduling of conferences or hearings that have been calendared on ECF, must be made by filing of a motion on the docket, in full compliance with all applicable Federal and Local Rules. Relief from deadlines, orders, and calendars may not be obtained by calling or emailing chambers staff or the Clerk's Office. Court staff cannot provide advice or guidance, and ex parte communications with the Court are generally improper. It is so ordered. Signed by Judge Sarah A. L. Merriam on 6/28/2022.(Caffrey, A.) |
