ORDER: dismissing without prejudice to refile #1 Motion to Quash Subpoena; granting #5 Motion to Continue. For the reasons stated in the parties joint motion, the parties stipulated motion to continue the discovery hearing #5 is GRANTED. See Catskill Mountains Chapter of Trout Unlimited, Inc. v. U.S. E.P.A., 630 F.Supp.2d 295, 304 (S.D.N.Y. 2009) (internal citations omitted). Accordingly, the Discovery Hearing scheduled for September 8, 2022, 4 is CANCELLED. Further, as the parties stipulate in their motion that there is no current dispute over discovery that requires judicial intervention, Plaintiffs motion to quash #1 is DISMISSED without prejudice to refile should a dispute arise. The parties are further ORDERED to file a Joint Status Report on the docket on or before October 8, 2022 indicating whether any discovery dispute remains or whether this case can be closed, since the motion to quash has been resolved.
