Filing 12 ORDER granting #11 Motion to Withdraw; terminating #4 Motion to Appoint Counsel; terminating #5 Motion for Order. Mr. Hajati's motion to withdraw is GRANTED. In light of Mr. Hajati's request to withdraw this case, the Court dismisses this case without prejudice under Federal Rule of Civil Procedure 41. See Fed. R. Civ. P. 41(a)(1)(A)(i) ("[T]he plaintiff may dismiss an action without a court order by filing: a notice of dismissal before the opposing party serves either an answer or a motion for summary judgment...."). In light of the dismissal of this case, the other pending motions are terminated. The Clerk of Court is respectfully directed to close this case. Signed by Judge Victor A. Bolden on 4/20/2023. Filing 11 MOTION to Withdraw by George Hajati. (Attachments: #1 envelope)(Imbriani, Susan) |
Filing 10 ORDER denying #2 Motion for Leave to Proceed in forma pauperis. In his motion for leave to proceed in forma pauperis, Mr. Hajati asserts that he is "unable to pay" the filing fee. He does not, however provide any additional information regarding his financial status, including his income, assets, and expenses. "When an applicant fails to explain how he supports himself, courts generally regard his application as incomplete and insufficient to establish an entitlement to in forma pauperis status." Dan M. v. Kijakazi, No. 3:22-cv-664 (SRU), 2022 WL 2069112, at *2 (D. Conn. May 19, 2022). Because Mr. Hajati has not provided any specific information regarding his financial circumstances, his motion for leave to proceed in forma pauperis is DENIED without prejudice to re-filing. If Mr. Hajati wishes to pursue this action further, then he must either file a renewed motion for leave to proceed in forma pauperis accompanied by a completed financial affidavit addressing the insufficiencies identified here or pay the required filing fee by April 28, 2023. A financial affidavit form indicating the required information is available on the District of Connecticut website at https://www.ctd.uscourts.gov/forms/motion-leave-proceed-forma-pauperis. Mr. Hajati is respectfully advised that failure to file a renewed motion or to pay the filing fee by this deadline may result in dismissal of the action.Signed by Judge Victor A. Bolden on 3/30/2023.
