Filing 8 VACATED:NOTICE OF INSUFFICIENCY. The plaintiff has filed a motion for leave to proceed in forma pauperis; in other words, he seeks to commence a federal lawsuit without pre-paying the filing fee. A federal law, 28 U.S.C. 1915, permits him to do so if, among other things, he files an affidavit demonstrating that he is unable to pay the fee. To assist inmate plaintiffs in making this demonstration, the District of Connecticut provides them with a six-page form to be filled out. In this case, the plaintiff did not complete Pages 2 and 4 of the form. Without a complete form, the Court cannot determine whether he is able to pay. Further, in his application, he certified that he did not have any cash, including in his inmate trust account. But, his inmate trust account statement shows that he had an account balance of $76.83 as of April 10, 2023. Therefore, the plaintiff has filed two meaningfully different representations of his financial resources. The plaintiff is reminded that all of his submissions must be truthful and accurate. Cf. Fed. R. Civ. P. 11; see also Emiabata v. Bartolomeo, No. 3:21-cv-776 (OAW) (TOF), 2022 WL 4080348, at *4-5 (D. Conn. Jan. 3, 2022) (granting in forma pauperis motion, but admonishing the plaintiff "that all of his future filings with the court must be candid and truthful, and that... untrue or materially incomplete filings may lead to sanctions"). The Clerk of the Court is respectfully directed to mail the plaintiff another copy of the application form at his address of record. The plaintiff is directed to complete all pages of the form and return it to the Clerk of the Court by May 10, 2023. If he does not do so, his case may be dismissed. Signed by Judge Thomas O.
