February 29, 2024 Opinion or Order Filing 10 ORDER DISMISSING ACTION AS DUPLICATIVE. On the basis of the Court's review of the complaint that has been filed in this action, it is apparent that the complaint is identical to the complaint filed by plaintiff in a prior pending action: Hernaiz v. Wagner, 24-cv-142. Accordingly, the complaint in this action is dismissed as duplicative and the pending motion for leave to proceed in forma pauperis (Doc. #2 ) is denied as moot. The Clerk of Court shall close this case. It is so ordered.Signed by Judge Jeffrey A. Meyer on 2/29/2024. (Pincus, K.)
February 27, 2024 Filing 9 NOTICE OF INSUFFICIENCY. The plaintiff has filed a motion for leave to proceed in forma pauperis; in other words, he seeks to commence a federal lawsuit without pre-paying the filing fee. A federal law, 28 U.S.C. 1915, permits him to do so if, among other things, he files an affidavit demonstrating that he is unable to pay the fee. To assist inmate plaintiffs in making this demonstration, the District of Connecticut provides them with a six-page form to be filled out. In this case, the plaintiff did not submit the prisoner authorization located on page four of the form. The Clerk of the Court is respectfully directed to mail the plaintiff another copy of the application form at his address of record. The plaintiff is directed to complete all pages of the form, including the authorization on page 4, and return it to the Clerk of the Court by March 18, 2024. If he does not do so, his case may be dismissed. Signed by Judge Thomas O. Farrish on 2/27/2024.(Corriette, M.)
