For the reasons explained in the attached, Order it is hereby ORDERED that the parties shall immediately request a copy of the transcript of the bench trial of this matter from the Court Reporter and shall inform the Court when they have obtained the transcript. It is further ORDERED that each party shall be permitted to file one post-trial brief, which shall be filed with the Court within 30 days of the parties' receipt of the trial transcript. It is further ORDERED that the parties' post-trial brief shall include and address:1. Proposed findings of fact; 2. Proposed findings of law; 3. Whether, assuming for the sake of argument that the plaintiffs did have common-law trademarks in the names that are the subject of this action, they lost the protection of United States trademark law when the United States imposed sanctions on and discontinued diplomatic relations with the Libyan government; and 4. Again assuming that the plaintiffs had common-law trademarks in the names that are at issue in this case and further that those trademarks lost the protection of the United States trademark laws when the United States imposed sanctions on and severed diplomatic relations with the Libyan government, what, if any, impact the termination of those sanctions and re-establishment of diplomatic relations with the Libyan government had on the trademarks that are the subject of this litigation. Upon consideration of Plaintiff Libyan Government's motion to alter or amend the Court's May 28, 2010 Order 77 and the applicable legal authority, the Court finds good cause to grant the motion. The documentation supplied by the plaintiffs supports the conclusion that Plaintiff Embassy of the Libyan Arab Jamahiriya has been properly identified in accordance with the Department of State's Diplomatic List, contrary to the rationale upon which the Court's decision to require the plaintiffs to amend their complaint was based. Accordingly, the plaintiffs need not amend the complaint in order to correctly articulate the name of Plaintiff Embassy of the Libyan Arab Jamahiriya as previously ordered.
