April 4, 2018 Opinion or Order MINUTE ORDER: The Court has received the parties' #260 Joint Motion to Extend Briefing Schedule for Motions-in-Limine, with respect to the supplemental briefing called for by this Court's #259 Memorandum Opinion and Order of March 29, 2018. CSP Defendants seek an eleven-week extension from the April 30, 2018, deadline ordered by the Court. For their responsive briefing, Plaintiffs seek an extension of approximately seventeen weeks from the May 22, 2018, deadline ordered by the Court. In addition to citing religious observances and counsel's trial calendars, the parties submit that the extensions should be granted because "most of the evidentiary issues raised in the motions-in-limine are key issues of dispute between and among the parties and that the Court's rulings on these matters will have a substantive and material impact on the trial." In the interest of effective briefing so as to facilitate this trial efficiently, the Court shall GRANT the parties' #260 Motion for good cause shown. May 10, 2017 Opinion or Order MINUTE ORDER: The Court has received the #239 Pretrial Statement, the objections thereto, and the parties' respective motions in limine. A preliminary review of these materials leads the Court to conclude that a pretrial conference in this matter, at this time, would be premature. Accordingly, the pretrial conference currently scheduled for May 15, 2017 at 9:30 A.M. is VACATED. The pretrial materials currently with the Court indicate that the primary trial-related dispute between the parties stems from the admissibility of evidence regarding Plaintiffs' alleged engagement in terrorist, criminal, or discriminatory practices. Nonetheless, in the Court's view, the materials do not adequately address the merits of either admitting or precluding evidence with respect to these alleged practices, especially as they pertain to the specific elements of the claims at issue in this matter. For this reason, the Court shall, subsequently, issue an order requiring additional briefing on these issues, and setting a new date for a pretrial conference in this matter. This order shall include specific instructions regarding the particular legal and factual points that must be addressed, and the manner in which those points should be addressed. In the Court's view, additional briefing shall facilitate the resolution of these issues, which shall greatly reduce the number of contested pretrial issues, and consequently, shall facilitate the efficient administration of the pretrial process, to the benefit of all involved. Attorney Michael Hanna's recent filings withdrawing as counsel for Plaintiffs, see ECF Nos. #214 , #215 , have brought to the Court's attention some lack of clarity regarding the attorneys now representing Plaintiffs CAIR-Foundation ("CAIR-F") and CAIR-Action Network ("CAIR-AN"). Hanna's filings represent that Haytham Faraj and Jenifer Wicks will continue to appear as attorneys for Plaintiffs. But the docket does not reflect that representation. Wicks previously filed a #202 Notice of Withdrawal and has not subsequently filed a Notice Appearance. Faraj filed a #213 Notice of Appearance only on behalf of CAIR-AN. If Wicks and Faraj intend to represent both Plaintiffs, they must file notices of appearance to that effect. Moreover, it appears that other counsel remain listed on the docket but may no longer be representing Plaintiffs. Attorney John Dill filed a #207 Notice of Withdrawal of Appearance; it appears that he may have intended to withdraw his appearance with respect to both Plaintiffs but that he mistakenly only filed the document with respect to CAIR-AN and, thus, the docket suggests that he continues to represent CAIR-F. On January 3, 2013, the Court held an on-the-record conference call with the parties regarding a dispute arising in connection with Plaintiffs' deposition of nonparty Frank Gaffney, President and CEO of Defendant Center for Security Policy (CSP), and more specifically, Plaintiffs' request to depose Mr. Gaffney for an additional 2.5 hours to further question him regarding CSP's donors. See #143 Joint Status Report Regarding a Discovery Dispute. Counsel participating in the call included: Mr. Abbas for Plaintiffs; Messrs. Horowitz and Garbus for the Gaubatz Defendants; and Messrs. Based on that development, the Court directed the parties to file a Joint Status Report designed to clarify the impact, if any, of CAIR's most recent filing on two other pending motions: Defendants' #34 Motion to Dismiss and CAIR's #43 Motion for Leave to File a First Amended Complaint. On April 22, 2011, the parties filed a #52 Joint Status Report, which is "joint" only in name and which the parties apparently took as an opportunity to raise a host of tangential and irrelevant matters that in no way clarify the relationship between the three aforementioned motions. To the extent the parties considered it appropriate to reargue their respective positions, they were mistaken; no such leave was granted and the Court will not consider the parties' submission in resolving the three pending motions. What is clear from the parties' report is that no narrowing of the issues has been achieved. CAIR's #48 Motion for Leave to File a Second Amended Complaint is yet to be fully briefed. Defendants Paul David Gaubatz and Chris Gaubatz subsequently filed a #34 Motion to Dismiss on December 20, 2009, which motion is now fully briefed. Thereafter, on February 2, 2010, Plaintiff filed a #40 Notice of Filing First Amended Complaint or, in the Alternative, Motion for Leave to File Same. Plaintiff asserted therein that it is entitled to file the First Amended Complaint as a matter of right under Fed. R. Civ. P. 15(a), as neither Defendant has yet filed an answer, or, alternatively, that the Court should grant Plaintiff leave to amend pursuant to Fed. R. Civ. P. 17(a), so that the claims may be asserted by the real party in interest. It appears that the Clerk's Office automatically docketed the First Amended Complaint based upon Plaintiff's representations that it is entitled to file the First Amended Complaint as a matter of right. Plaintiff, however, was in error, as it failed to acknowledge in its notice that Fed. R. Civ. P. 15(a) was amended, effective December 1, 2009, and no longer permits a party to amend once as a matter of right so long as no responsive pleading has been filed. Rather, the rule now provides that a party may amend its pleading once as a matter of course within either: (a) "21 days after serving it;" or (b) "if the pleading is one to which a responsive pleading is required, 21 days after service of a responsive pleading or a motion under Rule 12(b), (e), or (f), whichever is earlier." Accordingly, under the newly-amended Fed. R. Civ. P. 15(a), Plaintiff's deadline for amending its complaint once as a matter of right had passed well before its February 2, 2010 notice. As Plaintiff has misstated the applicable rule, its #40 Notice of Filing First Amended Complaint or, in the Alternative, Motion for Leave to File Same is DENIED WITHOUT PREJUDICE, and the Clerk's Office is directed to correct the docket in this case to reflect that the First Amended Complaint was docketed in error. Plaintiff may re-file an appropriate motion for leave to amend under Fed. R. Civ. P. 15 and/or 17, as it deems appropriate, by no later than March 1, 2010. January 7, 2010 Opinion or Order MINUTE ORDER (paperless). The Court held a status hearing with the parties on December 8, 2009, at which time the Court set a schedule for dispositive motions. See 12/10/09 Order, Docket No. #34 . Pursuant to that schedule, Defendants were to file their dispositive motion by no later than January 8, 2010, and, once such motion was filed and Plaintiff had an opportunity to review it, the Court indicated it would hold a status conference on January 12, 2010, to discuss any jurisdictional discovery issues Plaintiff may wish to raise related to Defendants' motion. As contemplated, Defendants filed their dispositive motion on December 20, 2009. The Court has now reviewed that motion and it does not appear to the Court that the motion raises any jurisdictional discovery issues that need to be discussed at this time or that Plaintiff will require jurisdictional discovery to respond to the arguments raised therein. As such, there appears to be no need to require the parties' attendance at the scheduled January 12th status hearing. The Court therefore proposes that the hearing be vacated and that the parties proceed with the briefing as scheduled. To the extent Plaintiff disagrees, Plaintiff must file a notice with the Court, by no later than12:OO PM NOON on Friday, January 8, 2010, indicating the specific jurisdictional discovery issues that it would raise at the scheduled status hearing. If Plaintiff does not timely file such notice, the Court shall assume Plaintiff agrees that the status hearing is unnecessary and shall vacate the January 12th hearing.
