Filing 44 ORDER, For the reasons set forth in the Memorandum Opinion entered this 26th day of May, 2011, it is hereby ORDERED that plaintiff's Motion for Judgment on the Pleadings 12 is GRANTED in part and DENIED in part; and it is further ORDERED that the defendants' Motion for Summary Judgment 14 is DENIED; and it is further ORDERED that the EPA Adminstrator issue a final agency action, either granting or denying plaintiff's permit application, no later than August 27, 2011.
