At the time of the filing of the motion, however, the above-captioned case was already closed, having been previously dismissed without prejudice by Memorandum Opinion and Order dated July 12, 2010. May 6, 2010 Opinion or Order MINUTE ORDER (paperless) GRANTING Plaintiff's opposed #8 Motion for Extension of Time to File Answer until and including May 27, 2010. The Court finds in its discretion that the extension of time is warranted in order to permit the Government additional time to determine whether to issue a scope of employment certification on the remaining allegation in this case. The Court advises Defendants, however, that the existence of the ongoing investigation by the agency's office of civil rights does not justify delay in the prosecution of this case, and the Court is disinclined to entertain future requests for extensions of time based upon that continuing investigation. April 13, 2010 Opinion or Order MINUTE ORDER (paperless). On March 25, 2010, Defendant the United States of America filed a #3 Motion for Extension of Time to File Answer. Specifically, Defendant sought a 45-day extension of time, making the United States' and Mr. Falahati's answer due May 10, 2010. Although Defendant indicated in its motion pursuant to LCvR 7(m) that Plaintiff opposed Defendant's request for an extension, Plaintiff declined to file an opposition to Defendant's motion by April 12, 2010, the deadline for any such response. Accordingly, upon consideration of the parties' positions, the Court GRANTS nunc pro tunc Defendant's #3 Motion for Extension of Time to File Answer. The United States' and Mr. Falahati's answer shall be due by no later than May 10, 2010. Finally, in light of this decision, the Clerk's Office is directed to STRIKE Plaintiff's #2 Notice to Clerk for Entry of Default. Given that an answer is not yet due, the affidavit of default is premature; moreover, as the Clerk advised Plaintiff's counsel on March 25, 2010, the affidavit for default lacks the necessary proof of service and is therefore procedurally deficient as well. April 13, 2010 Opinion or Order MINUTE ORDER (paperless). On April 2, 2010, Defendant filed a #7 Motion for Protective Order seeking to quash several subpoenas issued by Plaintiff to employees of the Broadcasting Board of Governors. On April 6, 2010, the Court issued a temporary protective order to allow Plaintiff time to respond to Defendant's motion and ordered Plaintiff to respond by no later than April 12, 2010. As review of the docket confirms, Plaintiff failed to file a response to Defendant's motion by April 12, 2010, or at anytime thereafter. Accordingly, the Court shall GRANT as conceded Defendant's #7 Motion for Protective Order to quash the subpoenas issued by Plaintiff and which are attached to Defendant's motion. The parties are advised that once Defendant has filed an answer or otherwise responded to Plaintiff's complaint, the Court shall set an Initial Scheduling Conference, at which the Court shall establish a schedule for proceeding with discovery in this matter. On April 2, 2010, Defendant filed a #7 Motion for Protective Order seeking to quash several subpoenas issued by Plaintiff to employees of the Broadcasting Board of Governors. Because the dates for which the subpoenas at issue were noticed are imminent - if not already past - the Court shall issue a TEMPORARY protective order to allow Plaintiff time to respond to Defendant's motion. Plaintiff's response shall be due by no later than April 12, 2010. Upon receipt of Plaintiff's response, the Court shall then issue an order as to the manner in which this case should proceed.
