March 4, 2010 Opinion or Order MINUTE ORDER. Pursuant to Federal Rule of Civil Procedure 81(a)(5), the Federal Trade Commission (the "Commission") has filed a petition seeking an order requiring Church & Dwight Co., Inc. ("Church & Dwight") to comply in full with the June 29, 2009 Subpoena Duces Tecum and the June 29, 2009 Civil Investigative Demand issued to it in aid of a law enforcement investigation being conducted by the Commission (FTC File No. 091-0037). The Court hereby ORDERS Church & Dwight to SHOW CAUSE why this Court should not grant the Commission's petition and enter an order enforcing the June 29, 2009 subpoena and civil investigative demand by no later than March 18, 2010. The Commission shall file its reply by no later than March 25, 2010. A status hearing will be held on March 29, 2010 at 1:15 p.m. in Courtroom 24A. In the event that Church & Dwight finds its necessary to raise objections not previously made to the Commission, or present evidence not previously submitted to the Commission, Church & Dwight shall identify these objections or evidence as "new" in its response. Upon receipt of this Order, the Commission is directed to immediately serve a copy of this Order as well as its petition and exhibits upon Church & Dwight and defense counsel by personal service, by certified mail with return receipt requested, or by overnight express delivery service.
