November 26, 2019 Opinion or Order MINUTE ORDER: Upon consideration of Plaintiff, ICC-ES's, #151 Motion for Judgment on the Pleadings or, in the Alternative, for Sanctions Under Rule 16(f), the Opposition thereto, and Plaintiff's Reply, the motions are hereby DENIED. In the absence of a court order to the contrary, a 12(b)(6) Motion to Dismiss tolls the time by which a Defendant must file an Answer. See Fed. R. Civ. P. 12(a)(4). Of course, this court can and did modify the time by which Defendants here could file an Answer. See #123 Amended Scheduling Order. Defendants nonetheless did not respond to any allegations related to the Legacy Works in their Answer. See, e.g., #142 Answer to Third Amended Complaint 62. In light of Judge Sullivan's re-commitment of the Partial Motion to Dismiss to the undersigned for a Report and Recommendation, and the fact that the #123 Amended Scheduling Order has been vacated, the undersigned finds that the time for an Answer is currently tolled, so a Rule 12(b)(c) Motion for Judgment on the Pleadings is not well-founded. Moreover, while this court retains power to issue sanctions under Rule 16(f) for the failure to obey orders of this court, the undersigned declines to do so here. October 8, 2019 Opinion or Order MINUTE ORDER: Upon consideration of Judge Sullivan's 9/30/2019 Minute Order and the #130 Joint Status Report, the Status Conference set for October 10, 2019 is hereby VACATED. The court understands that there are three pending dispositive motions related to the Legacy Works claims. See ECF Nos. 77, 145, 151. There are also two pending motions to limit discovery on these claims pending the courts resolution of the dispositive motions. See ECF Nos. 146, 147. There is one pending discovery motion unrelated to the Legacy Works claims. See ECF No. 109. A stay would "prevent wasting the time and effort of all concerned." Chavous v. D.C. Fin. Responsibility & Mgmt. Assistance Auth., 201 F.R.D. 1, 2 (D.D.C. 2001) (citation omitted). Plaintiffs fail to demonstrate any prejudicial effect of a stay because they merely assert that "Defendants are engaged in ongoing, willful infringement" without outlining how that would actually affect Plaintiffs. See id. at 3-4; Pls.' Oppn to Defs.' Mot. for Stay of Disc. Pending Determination of Defs.' Dispositive Motions, ECF No. 149 at 5. The #123 Amended Scheduling Order is therefore VACATED. Defendants #146 Motion to Stay Discovery Pending Determination of Defendants' Dispositive Motions is GRANTED. Defendants' #147 Motion for Protective Order is DENIED AS MOOT. Further discovery will commence immediately in the event that the Legacy Works claims survive resolution of the dispositive motions. September 30, 2019 Opinion or Order MINUTE ORDER. Pending before the Court is #135 Defendants' Motion for Reconsideration re #123 Order on Motion to Dismiss, Order on Motion to Modify, Set/Reset Deadlines, Set/Reset Hearings. On June 11, 2019, Magistrate Judge Deborah A. Robinson, having been referred this case for full case management, entered an Amended Scheduling Order that, inter alia: (1) denied without prejudice Defendants' Partial Motion to Dismiss Plaintiff's Third Amended Complaint (''TAC''); (2) required Defendants to file an answer to the TAC; and (3) directed the parties to engage in discovery related to the Legacy Works. Am. Scheduling Order, ECF No. 123 at 1-2. Defendants challenge those three portions in the Amended Scheduling Order of June 11, 2019 (''Denial Order'') under Federal Rule of Civil Procedure 60(b), or in the alternative, under Rule 72(a). See Defs.' Mot., ECF No. 135 at 1-7. Defendants did not consent to the Denial Order. See Defs.' Mem., ECF No. 135-1 at 4; see also Joint Status Report, ECF No. 107 at 1. Magistrate Judge Robinson did not submit a report and recommendation (''R & R''), see generally docket of Civil Action No. 16-54, and Defendants did not request that Magistrate Judge Robinson issue a R & R, see Pl.'s Opp'n, ECF No. 143 at 7. Nonetheless, Defendants urge this Court to treat the Denial Order as a R & R, and sustain their objections to the Denial Order. See Defs.' Mem., ECF No. 135-1 at 12-16. Defendants rely on David v. District of Columbia, 252 F.R.D. 56, 59 (D.D.C. 2008) for the proposition that a district court may conduct a de novo review of a magistrate judge's ''one-word reason for denying a dispositive motion in the form of a minute order.'' Defs.' Reply, ECF No. 144 at 15. The Court disagrees. Plaintiff correctly notes that the David decision is distinguishable from this case. See Pl.'s Opp'n, ECF No. 143 at 4 n.2, 7. In David, the court treated as a R & R the magistrate judge's memorandum opinion and order awarding attorneys' fees and costs. 252 F.R.D. at 60. Here, it is undisputed that Magistrate Judge Robinson did not issue a memorandum opinion denying the partial motion to dismiss. See, e.g., Defs.' Mem., ECF No. 135-1 at 15; Pl.'s Opp'n, ECF No. 143 at 7. Plaintiff proposes, and Defendants do not contest, that ''the proper course would be for [this Court] to recommit the matter to Judge Robinson with instructions for substantive findings and recommendations.'' Pl.'s Opp'n, ECF No. 143 at 7 (citing LCvR 72.3(c)); see also Defs.' Reply, ECF No. 144 at 9. Substantially for the reasons set forth in #143 Plaintiffs Opposition, the Court will not treat the Denial Order as a R & R. The Court hereby refers #77 Defendants' Partial Motion to Dismiss Plaintiffs TAC to Magistrate Judge Robinson for a report and recommendation pursuant to Local Civil Rule 72.3(a)(3). In light of this referral, the Court finds as moot the parties' Rule 60(b) arguments. Because the Court referred this matter to Magistrate Judge Robinson for full case management, the Court defers to Magistrate Judge Robinson on whether the Amended Scheduling Order, ECF No. 123, should be stayed pending the resolution of Defendants' partial motion to dismiss.
