Filing 49 MEMORANDUM OPINION AND ORDER: Plaintiffs motion for leave to amend his complaint 41 is hereby GRANTED in part and DENIED in part. Plaintiff may file a second amended complaint including counts One, Two, Seven, Nine, Ten, Eleven, and Thirteen of t he proposed amended complaint [41-1], as well as count Six except to the extent that it alleges Privacy Act (as opposed to due process) claims; the remaining counts of the proposed amended complaint would be futile and plaintiff may not file them in the second amended complaint. Plaintiffs motion for appointment of counsel 27 is hereby DENIED. His motions for summary judgment 21 , 22 are hereby DENIED. His motion for entry of a default judgment and to strike the Cohen declaration 43 is hereby DENIED. Defendant George Chiamuleras motion to dismiss 11 is hereby GRANTED. Defendant the Millennium Challenge Corporations motion for summary judgment 17 is hereby DENIED. The Court will sua sponte dismiss counts Two and Three of the amended complaint 9 as against the Millennium Challenge Corporation. It is further ORDERED that plaintiff may not file any further motions without first conferring with the opposing parties and, if unable to resolve the issue, scheduling and participating in a pre-motion conference with the Court.
