September 7, 2018 Opinion or Order MINUTE ORDER. Pursuant to the July 10, 2018 decision of the United States Court of Appeals for the District of Columbia Circuit in Smith v. Trump, 16-5377, the Court hereby VACATES its #17 Order Granting Defendant's Motion to Dismiss. This Court granted Defendant's Motion to Dismiss due to lack of standing and the presence of non-justiciable political questions. Following this Court's dismissal, Plaintiff was discharged from the military, leading the Circuit Court to conclude that his appeal was moot. Because the appeal was moot, the case stands dismissed.
