MINUTE ORDER: The Court previously set a briefing schedule on Defendants' #5 Motion to Dismiss by Minute Order dated March 3, 2017. Subsequently, Plaintiff filed an #7 Amended Complaint, and an #8 Opposition that asks the Court to treat the pending Motion to Dismiss as moot in light of the Amended Complaint. Plaintiff was entitled to file an Amended Complaint as a matter of course, as it was filed "21 days after service of a motion under Rule 12(b)...." Fed. R. Civ. P. 15(a)(1)(B). Accordingly, the Court denies the pending Motion to Dismiss without prejudice. See Nat'l City Mortg. Co. v. Navarro, 220 F.R.D. 102, 106 (D.D.C. 2004) ("Because their motions to dismiss pertain to the original complaint, the court denies the motions without prejudice.").
