Filing 5 ORDER advising Plaintiff to respond by January 22, 2019 to the Court's order granting Defendant's #4 Motion or risk dismissal of the case. See Order for details. Signed by Judge Timothy J. Kelly on 12/20/2018. (lctjk1) |
MINUTE ORDER treating as opposed and GRANTING Defendant's #4 Motion for a More Definite Statement. Plaintiff is advised that under Federal Rule of Civil Procedure 8(a), a complaint must contain "a short and plain statement of the claim showing that the pleader is entitled to relief" and "a demand for the relief sought." Under Rule 12(e), a party may move for a more definite statement of a pleading when its claims are "so vague or ambiguous that the party cannot reasonably prepare a response." "[E]ven though a pro se complaint must be construed liberally, the complaint must still present a claim on which the Court can grant relief." Budik v. Dartmouth-Hitchcock Med. Ctr., 937 F. Supp. 2d 5, 11 (D.D.C. 2013) (internal citation omitted). Plaintiff's complaint does not "specify the allegations in a manner that provides sufficient notice" to Defendant of the precise claims asserted and the relief sought. Swierkiewicz v. Sorema N.A., 534 U.S. 506, 514 (2002). Therefore, the Court hereby ORDERS Plaintiff to file an amended complaint with a more definite statement of his claims by January 22, 2019. Plaintiff is further advised that his failure to file an amended complaint in response to this Order may lead the Court to strike his Complaint (ECF No. 1-1), which would have the effect of dismissing the case. Signed by Judge Timothy J. Kelly on 12/20/2018. (lctjk1) |
