MEMO ENDORSEMENT on re: #6 Letter, filed by Al Jazeera International (USA) Inc., Al Jazeera Media Network, Deborah Davies, Al Jazeera America, LLC. ENDORSEMENT: Application GRANTED. The Court has reviewed the motion, filed by Ryan J. Howard, to quash a subpoena to non-party Verizon Wireless, or to transfer this matter to the U.S. District Court for the District of Columbia ("DDC"), where the underlying litigation is pending. (Dkt. #1-4). The Court has also reviewed the letter filed by counsel to Al Jazeera America, LLC, Al Jazeera Media Network, Al Jazeera International (USA) Inc., and Deborah Davies ("Al Jazeera"), consenting to the proposed transfer. The Advisory Committee Notes to Federal Rule of Civil Procedure 45 specify that "transfer may be warranted in order to avoid disrupting the issuing court's management of the underlying litigation, as when the court has already ruled on issues presented by the motion or the same issues are likely to arise in discovery in many districts." Fed. R. Civ. P. 45 Advisory Committee Notes. The Court agrees with Mr. Howard that transfer is appropriate here (i) because of the possibility of inconsistent results, given that Al Jazeera has served similar subpoenas on other nonparties in other jurisdictions, and (ii) because DDC is better suited to address the issues raised in Mr. Howard's motion given that there are pending motions in the underlying matter that implicate the scope of permissible discovery.(See Dkt. #2, at 8-10). The Court further notes transfer is appropriate in light of Respondent Al Jazeera's consent. Accordingly, the Clerk of the Court is directed to transfer this case to the U.S. District Court for the District of Columbia, terminate all pending motions, adjourn all remaining dates, and close this case.
