February 5, 2019 Opinion or Order MINUTE ORDER (Paperless). Pro se Plaintiff initiated an action in Precinct 1 of the Justice Court of Williamson County, State of Texas. In her Small Claims Case Petition, she indicated that she had "opted out of the [federal] class action lawsuit" and was seeking relief separately. Defendant Southwest Airlines ("Southwest") removed the case to the United States District Court for the Western District of Texas. Shortly thereafter, the case was transferred to this Court by the Judicial Panel on Multidistrict Litigation. Plaintiff has now requested that this case be "moved back to the West Division [Texas] US Court." See Suggestion of Remand, ECF No. 7. In connection with Plaintiffs request, this Court would benefit from a response by Defendant Southwest Airlines. Accordingly, counsel for Southwest shall first enter an appearance in this case. Southwest shall respond to Plaintiff's suggestion of remand by no later than February 19, 2019, and it shall confirm with the class action administrator whether or not Plaintiff Catherine Richmond received notice of the class action, and if so, whether she opted out of the class with regard to the pending settlement by Southwest in the case In re: Domestic Airline Travel Antitrust Litigation, 15mc1404, or alternatively, whether Ms. Richmond is a member of the class. The response shall indicate further whether Ms. Richmond filed any objection to the pending settlement. Ms. Richmond may reply to Southwest's response by no later than March 5, 2019.
