MINUTE ORDER denying Defendant's Motion to Dismiss or, In the Alternative, for Summary Judgment. Defendant moves to dismiss on the ground of mootness, arguing that Plaintiff has received the relief sought: a determination on his wife's visa application. "Where the plaintiff has recovered all it has sought, no court action can provide further relief and the case is moot." Judicial Watch, Inc. v. Kerry, 844 F.3d 952, 954 (D.C. Cir. 2016). Here, Plaintiff seeks as relief more than the processing of his wife's visa application. He also challenges under the Administrative Procedure Act the policy that the government uses to evaluate visa applicants. Given the representation that Plaintiff's wife's visa application is again being reviewed, presumably under the very policy that Plaintiff challenges, this is a not a case in which "no court action can provide further relief."
