Set/Reset Deadlines: Time to effectuate service upon party due by 9/13/2019. (kt) |
MINUTE ORDER: On June 14, 2019, Plaintiff filed this civil action, proceeding pro se, against several defendants. On that same date, Plaintiff filed a motion to proceed in forma pauperis (IFP). Dkt. 2. Under the governing rules, if a party files and obtains IFP status, then the responsibility for effectuating service of process rests with the officers of the courts. See 28 U.S.C. 1915; Fed. R. Civ. P. 4(c). On July 1, 2019, however, Plaintiff paid the requisite $350 filing fee, and in doing so, rendered his IFP motion moot. Plaintiff's IFP motion #2 is, accordingly, DENIED as moot. The Court, therefore, advises Plaintiff that he is solely responsible for effecting service on Defendants in compliance with Federal Rule of Civil Procedure 4 on or before September 13, 2019. See Fed. R. Civ. P. 4(m). If Defendants are not properly served on or before September 13, 2019, the Court will dismiss this action without prejudice unless Plaintiff shows good cause for the Court to extend the time to effect service. Id. Signed by Judge Randolph D. Moss on 08/05/2019. (lcrdm2, ) |
