MINUTE ORDER granting in part #12 Defendants' Motion to Dismiss Plaintiff's Complaint or, in the Alternative, Motion to Stay Further Proceedings Pending Administrative Action. On July 23, 2019, Defendant United States Citizenship and Immigration Services administratively reopened Plaintiff HK Corporation ("HK")'s I-129 petition, vacated the June 19, 2019 decision, and issued a supplemental Request for Evidence to HK. Def.'s Mem. in Support of Def.'s Mot. to Dismiss, ECF No. 12-1 at 7; see also Def.'s Ex. B, ECF No. 12-2 at 6-25. The Court hereby grants Defendants' unopposed motion to stay further proceedings pending administrative action, and finds as moot #3 Plaintiffs' Motion for Preliminary Injunction. The Court holds in abeyance Defendants' motion to dismiss and stays further briefing on the motion to dismiss. See Furniture Brands Int'l Inc. v. U.S. Int'l Trade Comm'n, No. 11-202, 2011 WL 10959877, at *1 (D.D.C. Apr. 8, 2011). The parties are directed to file a joint status report by no later than September 23, 2019.
