MINUTE ORDER sustaining defendant's objection to notice of related case. Upon consideration of the notice of related case filed by plaintiffs, defendants' objection, and plaintiffs response thereto, the Court had determined that this action is not related to this Court's case in Grace v. Barr, No. 18-cv-1853 (EGS) (D.D.C.), appeal pending, Grace v. Barr, No. 19-5013 (D.C. Cir.). Under Local Civil Rule 40.5, Civil, including miscellaneous, cases are deemed related when the earliest is still pending on the merits in the District Court and they (i) relate to common property, or (ii) involve common issues of fact, or (iii) grow out of the same event or transaction. This Court has held that an earlier case is not still pending on the merits in the District Court if it is on appeal. See Keepseagle v. Glickman, 194 F.R.D. 1, 3 (D.D.C. 2000)([E]xcept in unusual circumstances, a case cannot still be pending on the merits in the district court once an appeal has been properly taken because the case would not be appealable absent a final judgment.). Although there may be unusual circumstances that would justify a Court to accept a case as related to an earlier case that is pending on appeal, plaintiffs have not justified that request in this case.
