MINUTE ORDER. In Defendants' #16 Motion to Dismiss and Opposition to Plaintiff's Motion for a Preliminary Injunction, Defendants indicated that they had taken the actions requested in Plaintiff's Motion for a Preliminary Injunction, rendering the Motion moot. Specifically, in its Motion, Plaintiff requested that the Court order Defendants to (1) publish Plaintiff's TransportationIntermediary Bond Exemption Application immediately on Regulations.gov in a conspicuouslocation where the public can easily view and access it; (2) separate the Plaintiff's two exemption applications by assigning a new unique docket number to Plaintiff's Transportation Intermediary Bond Exemption Application; and (3) reset the statutory 30-day comment period after Defendants properly publish Plaintiff's Transportation Intermediary Bond Exemption Application in the Federal Register. If Defendants have taken the three actions requested in Plaintiff's Motion, the Court is inclined to deny without prejudice as moot Plaintiff's Motion. The Court ORDERS Plaintiff to file a Response by MAY 6, 2020 at 4:00 p.m. indicating whether or not Defendants have taken the actions requested in Plaintiffs Motion.
