MINUTE ORDER. The defense represented during the telephonic hearing on May 1, 2020 that Ankura is opposed to deleting or "returning" the misdirected emails that is the subject of the motion for preliminary injunctive relief because, in its view, the emails bear upon disputed issues in the ongoing arbitration (and possibly this case) concerning the terms of plaintiff Bell's separation from Ankura and whether he is in compliance with any applicable agreements not to compete. Given that representation, defendant is ordered to inform the Court by Wednesday, May 6, 2020 whether, assuming it is permitted to use the emails as evidence in litigation and arbitration, it is willing to agree not to use the emails or any information contained in any attachments to the emails for any business purpose, including the solicitation or performance of work for the plaintiffs' law firm that inadvertently sent the emails, or any other customer until the case has been resolved on the merits. MINUTE ORDER. At the telephonic hearing conducted on May 1, 2020, counsel for the defendants advised the Court that defendants will take immediate action to ensure that any email address at Ankura Consulting Group, LLC associated with plaintiff Edward J. Bell transmits an automatic "bounce back" notification stating that Edward J. Bell is no longer employed at Ankura, and he can no longer be reached at that email address. Defendants must file a notice with the Court by Monday, May 4 confirming that this notification has been put in place. During the hearing, counsel for defendants also represented that the link referenced in paragraphs 78, 186, 199, and 211 of the complaint is now inoperative and that it will not be reactivated, and the Court expects the defendants to abide by that representation. Finally, it is ORDERED that defendants must file a response to the motion for temporary restraining order/preliminary injunction #3 by May 15, 2020, and plaintiffs' reply will be due on May 22, 2020.
