MINUTE ORDER (paperless) GRANTING #35 Twin Metals Minnesota LLC's and Franconia Minerals (US) LLC's (collectively, "Twin Metals") Motion to Intervene. Federal Rule of Civil Procedure 24(a)(2) allows a movant to intervene as of right if (1) the motion to intervene is "timely," (2) the movant "claims an interest relating to the property or transaction that is the subject of the action," (3) the movant "is so situated that disposing of the action may as a practical matter impair or impede the movant's ability to protect its interest," and (4) the existing parties do not already "adequately represent that interest." The motion, filed three weeks after plaintiffs' complaint, is timely. See Roane v. Leonhart, 741 F.3d 147, 151 (D.C. Cir. 2014) (stating that the timeliness requirement "is aimed primarily at preventing potential intervenors from unduly disrupting litigation, to the unfair detriment of the existing parties"). Twin Metals' mineral leases are the "property... that is the subject of the action," Fed. R. Civ. P. 24(a)(2), and therefore Twin Metals has a direct interest relating to that property. Plaintiffs seek an order invalidating those leases, see Compl. at 38 (Prayer for Relief), and therefore disposition of this action could "impair or impede the movant's ability to protect its interest," Fed. R. Civ. P. 24(a)(2). Finally, Twin Metals' property interests in the leases are different from the government-defendants' regulatory interests in them, so Twin Metals meets the "low" bar for showing that the existing parties' representation is inadequate. Crossroads Grassroots Policy Strategy v. FEC, 788 F.3d 312, 321 (D.C. Cir. 2015); Southern Utah Wilderness Alliance v. Norton, 2002 WL 32617198, at *5 (D.D.C. June 28, 2002). Plaintiffs "take no positon [sic] on Twin Metals' motion to intervene because Twin Metals has not filed a pleading setting out the claims or defenses for which intervention is sought consistent with their obligations under Federal Rule of Civil Procedure 24(c)." See #50 Pls.' Response. Although Twin Metals has indeed not filed such a pleading, the D.C. Circuit has held that where there is "no claim... [of] inadequate notice" there is "no reason to bar intervention based solely upon this technical defect, if defect it be." Massachusetts v. Microsoft Corp., 373 F.3d 1199, 1236 n.19 (D.C. Cir. 2004) (en banc)); see also McCarthy v. Kleindienst, 741 F.2d 1406, 1416 (D.C. Cir. 1984) ("[P]rocedural defects in connection with intervention motions should generally be excused by a court."); Peaje Investments LLC v. Garca-Padilla, 845 F.3d 505, 515 (1st Cir. 2017) ("[D]enial of a motion to intervene based solely on the movant's failure to attach a pleading, absent prejudice to any party, constitutes an abuse of discretion."). Plaintiffs have not argued that, in substance, Twin Metals' motion provides inadequate notice. Accordingly, Twin Metals and Franconia Minerals shall be permitted to intervene as defendants as of right and are further DIRECTED to file an answer to the complaint or other responsive pleading on the date defendants are required to file an answer or other responsive pleading.
