MINUTE ORDER: It appears from the docket that Plaintiff has not complied with Local Rule 65.1, which requires that an application for a temporary restraining order be accompanied by proof satisfactory to the Court, showing "(1) that actual notice of the time of making the application, and copies of all pleadings and papers filed in the action to date or to be presented to the Court at the hearing, have been furnished to the adverse party; or (2) the efforts made by the applicant to give such notice and furnish such copies." LCvR 65.1. The Plaintiff is advised that the Court will decline to take up the motion unless and until proof of such notice pursuant to Local Rule 65.1 is provided. It further appears from the docket that the Plaintiff has not properly effected service of the Complaint on the Defendants. The Court will not take up Plaintiff's #5 preliminary injunction motion unless and until the Complaint is properly served. Plaintiff is advised that he must serve the Complaint within 90 days of filing, see Federal Rule of Civil Procedure 4(m), and file proof of service on the docket.
