September 23, 2020 Opinion or Order MINUTE ORDER. Plaintiff filed a #6 Motion for Entry of Default on September 16, 2020. In a minute order issued that day, the Court noted that Plaintiff's #5 Return of Service/Affidavit contained the words "District of Florida" instead of "District of Columbia." The Court ordered Plaintiff to "provide a supplemental filing correcting this discrepancy, explaining this discrepancy, and demonstrating when service of process was properly executed according to the Federal Rules of Civil Procedure." In response, Plaintiff filed a revised return of service affidavit that now contains the words "District of Columbia." ECF No. 8. But Plaintiff's #8 Response does not "explain[]" why the original return of service affidavit named the wrong Court. It is hereby ORDERED that Plaintiff shall make a filing containing this explanation by today, September 23, 2020, the original deadline. SO ORDERED. Signed by Judge Trevor N. McFadden on 9/23/2020. September 16, 2020 Opinion or Order MINUTE ORDER. Plaintiff has filed a #6 Motion for Entry of Default under Federal Rule of Civil Procedure 55(a). Plaintiff claims that it served Defendant on August 18, 2020, making Defendant's responsive pleading due by September 8, 2020. As proof of service, Plaintiff filed the #5 Return of Service/Affidavit. At the top of this document, below the words "United States District Court," are the words "District of Florida." Given this discrepancy, the Court cannot be confident that Plaintiff properly served Defendant with the summons and Complaint in this civil action, which is in the United States District Court for the District of Columbia. It is hereby ORDERED that, on or before September 23, 2020, Plaintiff shall provide a supplemental filing correcting this discrepancy, explaining this discrepancy, and demonstrating when service of process was properly executed according to the Federal Rules of Civil Procedure. SO ORDERED. Signed by Judge Trevor N. McFadden on 9/16/2020. (lctnm2)
