MINUTE ORDER granting #7 Joint MOTION to Consolidate Cases. Parties seeks consolidation of this case with UNITED STATES OF AMERICA v. DAIMLER AG et al, 20-cv-02564. Under Rule 42(a) of the Federal Rules of Civil Procedure, the Court may consolidate a case "If [the] action[] before the court involve[s] a common question of law or fact, the court may." The Court's Local Civil Rule 40.S(d) is not implicated in this instance because both cases are assigned to this Court. The decision whether to consolidate cases under Rule 42(a) is within the broad discretion of the trial court. Am. Postal Workers Union v. U.S. Postal Serv., 422 F. Supp. 2d 240, 245 (D.D.C. 2006) (internal citation omitted). "When determining whether to exercise such discretion, 'courts weigh considerations of convenience and economy against considerations of confusion and prejudice.'" Id. (internal citation omitted). Upon consideration of this joint motion and the common questions of fact, the Court finds that convenience and judicial economy favor consolidation, and is not likely to cause confusion or prejudice any party. This action is hereby consolidated for all purposes with UNITED STATES OF AMERICA v. DAIMLER AG et al, 20-cv-02564. Further, all future filings shall be under Case Number 20-cv-02564.
