December 2, 2020 Opinion or Order MINUTE ORDER: The parties are hereby ORDERED to meet and confer and, by December 9, 2020, propose a schedule (or competing schedules) for simultaneous briefing of both defendants' anticipated motion to dismiss for lack of jurisdiction and a renewed summary judgment motion on all three claims in plaintiffs' complaint, as well as production of the administrative record. The Court finds that consideration of all extant legal issues through two parallel rounds of briefing best balances the interest of judicial efficiency and the need to expeditiously resolve this matter in light of the one-year period that states have to adopt the subject MOU.
