MINUTE ORDER: The Court has received the Defendant's #11 Motion for Extension of Time, which represents the Defendant's first request for an extension in this case. Defendant's response to Plaintiffs' #9 Motion for Summary Judgment is presently due on April 27, 2021. Defendant's answer to Plaintiffs' complaint is presently due on May 24, 2021. In its motion, Defendant requests that the Court extend both deadlines to May 28, 2021. Plaintiffs consent to an extension until May 28, 2021 for Defendant's answer, but propose a shorter extension until May 17, 2021 for Defendant's summary judgment response. Over Plaintiffs' objection and in an exercise of the Court's discretion, the Court will GRANT Defendant's #11 Motion, which will allow Defendant sufficient time to compile and review the requisite administrative record in order to prepare responses to Plaintiffs' complaint and motion for summary judgment and to serve that record concurrently with any simultaneous cross-motion for summary judgment. Accordingly, the Court ORDERS that Defendant shall file its answer to Plaintiffs' complaint and its summary judgment response by or before MAY 28, 2021.
