MINUTE ORDER: Upon consideration of Plaintiff's motion to remand to state court, Dkt. #9 , and Defendant's response, Dkt. #11 , it is hereby ORDERED that the motion is DENIED. Plaintiff's complaint alleges one count of "[r]ace [d]iscrimination." Dkt. 1-1 at 7. At the conclusion of that count, the complaint alleges: "Defendant's actions have exposed it to liability under Title VII and [the] DC Human Rights Act (DCHRA) of 1977 for discrimination." Id. at 8. This language unambiguously asserts claims under both the DCHRA and Title VII. Because this Court has original jurisdiction over civil actions "arising under the Constitution, laws, or treaties of the United States," 28 U.S.C. 1331, and Title VII is such a law, Defendant properly removed this case under 28 U.S.C. 1441(a), which allows removal of any civil action "of which the district courts of the United States have original jurisdiction." Although Plaintiff now disclaims any intention of bringing a Title VII claim, a Title VII claim appears on the face of the complaint. Disclaiming federal claims after removal cannot justify remand, because "a plaintiff's change in legal theory cannot defeat jurisdiction if a federal question appeared on the face of the complaint." Herero People's Reparations Corp. v. Deutsche Bank, A.G., 370 F.3d 1192, 1195 (D.C. Cir. 2004); Cannon v. Wells Fargo Bank, N.A., 908 F. Supp. 2d 110, 113 (D.D.C. 2012).
