MINUTE ORDER. Before the Court is the plaintiffs' #8 Motion for a Preliminary Injunction. Under the Local Rules, "a hearing on an application for preliminary injunction shall be set by the Court no later than 21 days after its filing, unless the Court earlier decides the motion on the papers or makes a finding that a later hearing date will not prejudice the parties." LCvR 65.1(d). Both briefing schedules proposed by the parties contemplate that any hearing on this motion will occur well after the date contemplated by the Local Rules. See Defs.' Proposed Briefing Schedule, Dkt. 10; Pls.' Proposed Briefing Schedule, Dkt. 11. For this reason and based on the Court's review of the plaintiffs' #8 Motion, the Court finds, pursuant to Local Rule 65.1(d), that a later hearing date or resolution of the motion "will not prejudice the parties." The plaintiffs have not explained why a one-week delay in the briefing schedule will unduly prejudice them, and resolution of their motion has been delayed in part because of their own delay in effecting service of their motion, see Min. Order of Jun. 25, 2021. Accordingly, the Court adopts the following briefing schedule: the defendants shall file their opposition to the plaintiffs' motion on or before July 22, 2021; the plaintiffs shall file any reply on or before July 29, 2021. Once the Court reviews the briefs, it will determine whether a hearing on the motion is necessary. So Ordered by Judge Dabney L. Friedrich on July 2, 2021. (lcdlf1) |
