Plaintiff submitted a timely response, ECF No. 9, which does not comply with the Minute Order. Review of the docket confirmed that no filing fee has been paid to this Court or to the United States District Court for the Southern District of New York prior to transfer of this action. It is hereby ORDERED that, within 30 days of this Order, plaintiff pay the $402 filing fee in full, or, alternatively, shall file an application to proceed in forma pauperis. If plaintiff fails to comply with this Minute Order, the Court may dismiss the complaint and this civil action without prejudice. So ordered by Judge Dabney L. Friedrich on June 7, 2021. (psu2)

May 19, 2021 Opinion or Order MINUTE ORDER. The U.S. District Court for the Southern District of New York transferred this action to this Court without requiring payment of the filing fee pursuant to 28 U.S.C. 1914 or granting leave to proceed in forma pauperis (IFP) under 28 U.S.C. 1915. Within 30 days from the entry date of this order, plaintiff shall either pay the $402 filing fee applicable to this civil action or file an IFP motion. Failure to do either will result in dismissal of the case without prejudice. The Clerk shall enclose with this order an IFP form application, which plaintiff may complete or use as a guide.
