MINUTE ORDER. Upon review of the complaint in this case and in 21-cv-0538 and on the Court's own motion, the Court finds that this case is not related to 21-cv-0538. While at the administrative level, the plaintiff hospitals were both appealing similar calculations to the PRRB, what the lawsuits challenge here is the PRRB's dismissal of the plaintiffs' separate administrative appeals for lack of jurisdiction. The complaints involve different administrative appeals and the PRRB's dismissal of them was based on different procedural grounds. So there are no common issues of fact, and the cases do not grow out of the same event or transaction. Accordingly, the Court will submit this case to the Calendar and Case Management Committee for random reassignment. Signed by Judge Amy Berman Jackson on 5/26/21. (DMK)
