December 3, 2021 Opinion or Order MINUTE ORDER: Counsel for Plaintiff Lorenzo Brooks filed his notice to withdraw as attorney on September 27, 2021. Dkt. 17. This Court subsequently ordered the parties to "confer and file a joint status report with the Court" on or before November 5, 2021, "(1) indicating whether Plaintiff will proceed pro se or through newly retained counsel, and (2) proposing a schedule for further proceedings in this matter." Minute Order (Oct. 5, 2021). Defendants filed a status report on November 5, 2021, indicating that Plaintiff had informed them on October 12, 2021, that he intended to retain counsel, but that subsequent efforts to contact Plaintiff to discuss the status report were unsuccessful. Dkt. 18. The Court subsequently ordered Plaintiff to "file a notice with the Court on or before November 19, 2021, indicating (1) whether he intends to continue to pursue this action; and (2) whether he has retained counsel or will, instead, proceed pro se." Minute Order (Nov. 9, 2021). The Court expressly warned Plaintiff that failure to comply would prompt the Court to "conclude that Plaintiff does not intend to pursue the matter and [to], accordingly, dismiss this action without prejudice for failure to prosecute." Id. To date the Court has received no such notice, and no counsel for Plaintiff has entered an appearance. It is hereby ORDERED, as a result, that this action is DISMISSED without prejudice for failure to prosecute. The pending motion to dismiss, Dkt. 19, is therefore DENIED as MOOT. October 5, 2021 Opinion or Order MINUTE ORDER: On September 27, 2021, Plaintiff's counsel filed a motion to withdraw as counsel, Dkt. #17 . As required by Local Rule 83.6(c), this motion included a certification (1) that counsel has served the motion upon Plaintiff at his last known address, (2) that counsel advised Plaintiff that he would need to obtain other counsel or proceed pro se, and (3) that counsel advised Plaintiff that he would need to inform the Court within 7 days if he intends to proceed pro se or objects to the withdrawal of current counsel. Plaintiff has not objected to counsel's withdrawal and has not otherwise informed the Court whether he intends to proceed pro se or with other counsel. Therefore, it is ORDERED that the motion is GRANTED and that Keith W. Watters is granted leave to withdraw his appearance as counsel for Plaintiff. It is further ORDERED that on or before November 5, 2021, the parties shall confer and file a joint status report with the Court (1) indicating whether Plaintiff will proceed pro se or through newly retained counsel, and (2) proposing a schedule for further proceedings in this matter. Either Plaintiff or new counsel for Plaintiff, if retained, shall appear at the video status conference set for December 10, 2021, at 9:00 a.m. The Deputy Clerk is directed to mail this order, along with instructions for accessing the video status conference, to Plaintiff at the address listed in Plaintiff's counsel's motion to withdraw, Dkt. #17 , at page 5.
