July 29, 2021 Opinion or Order MINUTE ORDER: The Court has received the #16 Index to the Administrative Record (Unclassified). The Court has not, however, located the Administrative Record itself on the docket. The Court previously ordered the government to file "the complete administrative record that is relevant to the challenged agency action in this matter." Order, ECF No. 8, at 3. The Court cannot rule on the outstanding motion for a preliminary injunction until the government has filed the appropriate administrative record on the docket. See Am. Bioscience, Inc. v. Thompson, 243 F.3d 579, 582 (D.C. Cir. 2001) ("We hold only that the court, before assessing American Biosciences probability of success on the merits, should have required the FDA to file the administrative record and should have determined the grounds on which the FDA granted Baker Nortons application."). Accordingly, it is hereby ORDERED that the government file the unclassified administrative record as a separate entry on the docket today, JULY 29, 2021. July 23, 2021 Opinion or Order MINUTE ORDER: In reviewing the legal claims presented in Plaintiffs' motion for a preliminary injunction, the following issues have come to the Court's attention, which may be applicable to Plaintiffs' present request for relief: (1) Whether Plaintiffs' de facto debarment claim is grounded in constitutional due process? See, e.g., Kartseva v. Dep't of State, 37 F.3d 1524, 1528 (D.C. Cir. 1994); and (2) What constitutional due process rights do Plaintiffs possess as foreign entities? See, e.g., People's Mojahedin Org. of Iran v. U.S. Dep't of State, 182 F.3d 17, 22 (D.C. Cir. 1999). The government should address these issues in its forthcoming reply brief.
